Child Support

California courts will take several factors into consideration when making a determination about child support, specifically the income of the parties. However, in most cases, support is determined based upon set guidelines.

Child Custody

A challenging aspect of any divorce is child custody. In California, the court considers the best interests of the child when making any custody orders if the parties are in disagreement. Frequent and continuous contact with both parents serves this interest.

Types of Custody

• Legal Custody – a parent can make legal decisions regarding the health, education, religion, and other important matters of the child
• Physical Custody – custody awarded to the parent with whom the child will live, with visitation awarded to the non-custodial parent

Uncontested Divorce

An uncontested divorce is one in which the parties are amicable and agree to the terms relating to child custody and support, spousal support, and division of community property assets and debts. Mediation would be a great resource for an uncontested divorce.

Contested Divorce

A contested divorce is one in which the parties are contentious and cannot come to an agreement on child custody, division of assets and debts, child support, spousal support or other issues. It is important for the parties to understand their rights so that they may make informed decisions throughout the divorce process.
